Terms of service
Terms of Service — WrapGuard
Effective date: Upon publication on getwrapguard.com
Website: https://getwrapguard.com
Introduction
These Terms of Service (“Terms”) govern use of the WrapGuard online store and purchases made through https://getwrapguard.com (the “Store”). The seller is Matěj Merunka, trading as WrapGuard, a sole trader registered in the Czech Republic, Company Identification Number (IČO): 29686024, business address: Kosí 187, Zdiměřice, 252 42 Jesenice, Czech Republic (“WrapGuard”, “we”, “us” or “our”). Contact: info@getwrapguard.com, phone +420 776 371 311.
The Store runs on Shopify. These Terms apply to customers worldwide, subject to the mandatory consumer protections and other non-waivable laws applicable in the customer's country. No provision of these Terms removes a right that cannot lawfully be excluded. Specific product descriptions, confirmed order details, agreed specifications and any individual written agreements form part of the contract. Please also read our Refund & Returns Policy, Shipping & Delivery Policy and Privacy Policy.
Section 1 — Access and customer accounts
You may use the Store only for lawful purposes. To place an order, you must be legally able to enter into a purchase contract under applicable law. You agree to provide accurate and up-to-date contact, billing, shipping and vehicle information. If you have a customer account, you are responsible for keeping your login information secure and for notifying us of suspected unauthorized use. We may restrict an account where reasonably necessary to prevent fraud or misuse, without affecting valid existing orders or statutory rights.
Section 2 — Products, descriptions and visualizations
WrapGuard offers vehicle covers and related products, including covers made to a customer's individual specifications. Product pages describe the applicable design, materials, customization and intended use. We aim to represent products accurately; screen settings, lighting, fabric texture and printing processes may affect perceived colors and appearance.
Any free AI visualization, conceptual preview or advertising image is indicative and is not, by itself, the final manufacturing specification. For customized orders, the final expressly approved design together with the agreed vehicle specifications and product characteristics forms the manufacturing reference. We remain responsible for delivering goods conforming to the contract and applicable consumer law. We may change future product offers without altering orders already accepted.
Section 3 — Orders and contract formation
Placing an order is an offer to purchase the specified product. Before submitting, check the model, year, body style, selected options, design requirements, delivery details and total price. We will acknowledge and accept orders in writing, generally by an order-acceptance or processing confirmation email; the purchase contract is formed when we expressly accept the order. An automated receipt that clearly states it only acknowledges receipt does not necessarily constitute acceptance.
If we cannot accept an order, we will notify you and refund any payment already taken without undue delay. Once accepted, the seller undertakes to supply the agreed product and the customer undertakes to pay and cooperate with necessary design approvals. Approval of the final design is a production milestone, not the moment at which the purchase contract is formed. Customized orders and cancellations are further addressed in Section 25. Separate written commercial arrangements may apply to business-to-business orders.
Section 4 — Prices, taxes and payment
The currency, price, applicable taxes and separately charged shipping or other mandatory costs are shown before the customer completes the order. We disclose the total payable amount as required by applicable law. Prices and offers may change for future orders, but the confirmed contract price is not changed unilaterally. A discount or promotion may carry clearly stated additional conditions.
For destinations outside the relevant customs territory, import duties, import VAT, brokerage or customs fees may apply depending on the destination, shipping arrangement and whether charges are collected at checkout. We will disclose known arrangements and costs before purchase where required by law; charges expressly included in the checkout total will not be charged again by us. Where the customer is the importer of record and duties are not prepaid, the customer may be charged by customs or the carrier. Payment is processed through the methods shown at checkout, using relevant payment providers. All customers must be authorized to use their selected payment method.
Section 5 — Production, shipping and delivery
Custom covers require design preparation, customer approval, manufacturing and shipping. The usual production and preparation estimate is approximately 4–6 weeks, subject to the design process, customer cooperation and any individually agreed delivery date. Physical production begins only after the customer expressly approves the final design. Estimated transit times and delivery charges are set out in our Shipping & Delivery Policy and at checkout. Any agreed deadline and mandatory local delivery rights take precedence over general estimates.
Where consumer law requires delivery within a default period unless a longer period is agreed, an applicable longer lead time must be disclosed and agreed as part of the order. If a delivery deadline cannot be met, we will inform the customer and respect any rights to cancel, request a refund or otherwise obtain a remedy under the governing mandatory law. In particular, orders covered by the US FTC Mail, Internet, or Telephone Order Merchandise Rule are subject to its delay-notice, consent and cancellation/refund requirements.
For consumer deliveries, risk of accidental loss or damage generally passes when the customer or a person designated by the customer (other than the carrier) physically receives the goods, unless mandatory local law or a lawful exception provides otherwise. In some circumstances risk may transfer upon handover to a carrier independently chosen by the customer and not offered by us. Our Shipping & Delivery Policy explains transit estimates and procedures for damage in transit.
Section 6 — Intellectual property and customer-supplied materials
The Store's original content, product imagery, branding, graphics, text and designs are protected by applicable intellectual property laws and belong to their respective owners. Except where permitted by law, they may not be reproduced or commercially exploited without permission. Buying a physical cover does not automatically transfer copyright or exclusive rights in its graphics or design.
The customer warrants that any photos, logos, trademarks or other materials supplied for customization may lawfully be used for that purpose, and grants us permission to use them as necessary to develop and manufacture the ordered cover and administer the purchase. This does not automatically grant us permission to publish customer photographs or individual designs in advertising. Public promotional use will require an appropriate separate legal basis or permission.
Section 7 — Optional third-party tools
The Store may provide access to visualization tools, forms, payment services and other third-party functions. Separate supplier terms may apply to those services. We are not responsible for independent third-party services beyond the extent required by law, and remain responsible for our own obligations under the purchase contract.
Section 8 — External websites
The Store may link to independent third-party websites. Their owners are responsible for their own websites and practices. You should review applicable terms and privacy notices before using them. A link does not imply endorsement, unless expressly indicated.
Section 9 — Relationship with Shopify
WrapGuard is powered by Shopify, which provides the commerce infrastructure that makes our Store available. Sales and purchases made in the Store are concluded directly between the customer and WrapGuard, not Shopify. Shopify is not the seller of WrapGuard products and, to the maximum extent permitted by applicable law, is not responsible for the performance of those sales, related product defects or losses arising solely from a purchase from WrapGuard. Nothing in this section excludes rights or liabilities that cannot lawfully be excluded, including any rights that a customer may have directly against Shopify under a separate relationship or applicable law.
Section 10 — Privacy and data protection
We process personal information in accordance with our Privacy Policy, applicable data protection laws and, where relevant, the privacy notices of Shopify and other service providers. Providing information necessary to complete an order does not constitute consent to unrelated marketing. Customers may exercise applicable privacy rights as explained in our Privacy Policy.
Section 11 — Reviews and feedback
If you voluntarily submit a review, suggestion or other feedback for publication, you grant us a non-exclusive, royalty-free right to display and reasonably reproduce that feedback for the purpose for which it was submitted, subject to your rights and applicable law. You must not post unlawful, infringing, fraudulent or malicious material. Any broader promotional use of identifiable personal material is subject to applicable privacy and personality rights. We may moderate unlawful or abusive content in a proportionate manner.
Section 12 — Errors and corrections
We may correct typographical and factual errors in Store content. If we identify a material mistake before contract acceptance, we will inform the customer. Once a contract is concluded, the agreed price and specifications may not be changed unilaterally merely because of a general error disclaimer; mistakes and disputed terms are handled under applicable contract law.
Section 13 — Prohibited activities
You must not use the Store for fraud, harassment, infringement, unauthorized data collection, spam, distribution of harmful code, circumvention of security measures or activities that disrupt the Store. We may take proportionate protective measures, including restricting access, subject to law and the customer's existing contractual rights.
Section 14 — Ending use of online services
You may stop using the Store and may request account closure where permitted. Closing an account does not automatically cancel an accepted order, remove existing payment obligations or extinguish warranty and consumer rights. We may discontinue online features or restrict misuse without improperly cancelling concluded contracts.
Section 15 — Product conformity and website availability
We are responsible for supplying goods that conform to the contract and applicable mandatory requirements, including requirements relating to quality, fitness for purpose and consumer remedies. Free AI previews are not guaranteed to be exact representations of the finished cover, but the agreed characteristics and approved final design remain binding. We make reasonable efforts to maintain Store availability; temporary website outages do not remove our obligations under accepted orders.
Section 16 — Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including mandatory consumer guarantees, liability for fraud, intentional misconduct, or death or personal injury where exclusion is prohibited. We are not responsible for loss demonstrably caused solely by incorrect customer-supplied information, misuse, unauthorized modification or ordinary wear where we have fulfilled our own duties. Any other limitations of liability apply only to the extent permitted by the applicable law. Business customers may separately agree reasonable commercial limitations.
Section 17 — Third-party claims
Customers must have the necessary rights to supply photographs, logos and other design materials. Where unlawful customer-provided materials cause an established third-party claim or loss, responsibility will be determined under applicable law. Consumers are not required to provide unlimited indemnities for matters beyond their legal responsibility or for our own wrongful conduct.
Section 18 — Severability
If any provision is invalid or unenforceable, the other provisions remain effective to the extent legally possible. Mandatory applicable law replaces or prevails over an unlawful term.
Section 19 — Entire agreement and interpretation
The accepted order, these Terms, agreed product specifications, final design approval and any individual written arrangements constitute the parties' applicable contract. Individually agreed terms prevail over general terms where lawful. Failure to enforce a right once does not necessarily waive it. Consumer-contract ambiguities are interpreted in accordance with applicable consumer-protection law.
Section 20 — Assignment
Transfers or assignments of contractual rights and obligations are governed by applicable law. No assignment may unlawfully reduce consumer rights or relieve us of obligations without a legally valid basis.
Section 21 — Governing law and disputes worldwide
These Terms and purchase contracts are governed by Czech law, subject to any mandatory provisions of consumer law that cannot be displaced by a choice of law. In particular, consumers in countries whose mandatory protections apply to an order retain those protections, including as relevant in the EU, UK, Australia and other destinations. This choice of law is not a representation that Czech consumer rules apply exclusively or identically worldwide.
Court jurisdiction is determined by applicable procedural and private international law. No clause requires a consumer to waive a mandatory right to bring proceedings in a competent local court. We encourage customers to contact us first at info@getwrapguard.com to seek a practical resolution.
Section 22 — Headings
Headings are for convenience and do not change the meaning of the Terms.
Section 23 — Updates to these Terms
We may update these Terms for future purchases. The version applicable to an order is normally the version in effect when the contract was formed, unless a valid later agreement or mandatory law requires otherwise. Posting a revised version does not retroactively remove existing consumer rights.

Section 25 — Custom-made products, design approval and cancellation
25.1 Individual specifications
Many WrapGuard products are made specifically for a customer's vehicle and selected configuration, with individually determined measurements, materials, graphics, colors, placement of logos and other agreed details. Only an order that actually meets the applicable legal definition of custom-made or clearly personalized goods is treated as exempt from statutory change-of-mind cancellation rights. Merely describing a mass-produced item as “made to order” does not necessarily establish an exemption.
25.2 EU/EEA and UK withdrawal exception
For qualifying personalized goods, the standard 14-day withdrawal right without giving a reason does not apply under Article 16(c) of EU Directive 2011/83/EU and, where applicable, Section 1837(d) of the Czech Civil Code, or equivalent local implementations. The UK also provides an exception for goods made to a consumer's specifications or clearly personalized. Where that legal exemption applies, it is not dependent on whether physical production has started.
25.3 Other countries
In other countries, cancellation, cooling-off and consumer guarantee rights depend on local law. These Terms do not seek to override a non-waivable cancellation, refund or remedy right. For example, shipping delays may create cancellation/refund rights under US rules even for an order for a customized item; defective goods remain subject to mandatory Australian Consumer Law protections where applicable.
25.4 Professional design work
An accepted custom order can involve paid professional design work and production planning before manufacturing begins. The included professional design process is distinct from any free, non-binding AI visualization offered before purchase. You may review and request revisions to the design within the scope expressly advertised and agreed for your order. Where “unlimited revisions” are offered, they apply to revisions of the agreed design brief before final approval, not to new standalone products or unrelated briefs without a separate agreement.
25.5 Final approval
We do not start physical production until the customer expressly approves the final design. Approval may be given by email or another recorded method and will be used together with the agreed vehicle specifications as the manufacturing reference. Customer silence does not constitute approval.
25.6 Cancellation due to a change of mind
Where the applicable law excludes a change-of-mind withdrawal right for a qualifying customized product, the customer cannot unilaterally cancel an accepted order merely because they changed their mind, even before final design approval. A customer may request cancellation at any time; if no statutory or agreed cancellation right exists, cancellation requires our mutual agreement. If we agree to cancel, any refund and allocation of documented, reasonable design or production costs will be clearly agreed as part of that cancellation. No automatic non-refundable deposit or automatic forfeiture of the entire price is created by this clause.
25.7 Non-performance and statutory rights
You are not required to approve a design that fails to meet the agreed brief. If we cannot deliver as agreed, materially breach the contract, miss a legally relevant shipping deadline or supply defective goods, applicable rights to repair, replacement, price reduction, cancellation or refund remain intact. Design costs cannot be used to deduct amounts from a refund where the law requires a full refund.
Section 26 — Vehicle brands and trademarks
Names and images of vehicle manufacturers and models are generally used to identify compatibility and describe our products. Unless expressly stated, WrapGuard is not affiliated with, approved by, licensed by or sponsored by those manufacturers. All trademarks belong to their respective owners. Where a genuine partnership exists, it may be specifically identified, subject to relevant permissions.
Section 27 — Manufacturing tolerances and variations
Customized textile products may show minor differences in fabric tension, printing color, placement or finishing caused by normal manufacturing processes, screen rendering and the physical properties of the product. A variation is not automatically permissible just because it is small or does not affect basic function. Product conformity is assessed against the agreed specifications, any validly disclosed and accepted tolerances, reasonable expectations and applicable mandatory consumer standards. Where legally required, any departure from objective conformity requirements must be expressly and separately accepted by the consumer. A product that does not conform may be defective even if usable.
Section 28 — Defective products and consumer remedies
Contact info@getwrapguard.com with your order number, a description of the problem and, if available, photographs. Photos can help assessment but are not an absolute condition of making a statutory claim. We may reasonably ask to inspect the product.
Depending on applicable law, consumers may be entitled to repair or replacement, a price reduction, rejection of goods or a refund. EU consumers generally have at least two years of statutory protection for non-conforming goods; under Czech consumer law, defects existing at delivery and appearing within two years may be claimed, subject to statutory rules. This is not the same thing as an additional voluntary “24-month warranty.” For buyers elsewhere, applicable statutory rights and any separate, expressly advertised commercial warranty govern. We do not impose a universal 12-month warranty cutoff on customers outside the EU.
Czech consumer complaints subject to the Czech Consumer Protection Act will normally be resolved within 30 calendar days unless a longer period is validly agreed. Other mandatory local time limits prevail where applicable. Legitimate statutory defect remedies are provided without charges prohibited by law. A custom-made product remains fully eligible for statutory remedies when defective.
Section 29 — Customer complaints and alternative dispute resolution
Please contact info@getwrapguard.com first so we can try to resolve any issue. For relevant disputes with consumers, the Czech Trade Inspection Authority (Česká obchodní inspekce), https://adr.coi.cz, is an available out-of-court dispute resolution body under Czech law. Cross-border consumers may also have access to consumer advice or dispute-resolution mechanisms in their country. None of these provisions restricts mandatory rights to bring legal proceedings before a competent court.
Section 30 — Use of covers and condition of the vehicle
30.1 Condition of the vehicle. The covers are intended to be placed on a vehicle that is clean, dry and in sound condition. The condition of the vehicle at the time of covering, including its paintwork, clear coat, wraps, films, trim and any existing damage, corrosion, or loose or poorly adhered parts, is outside our control.
30.2 Responsibility of the customer. The customer is responsible for making sure the vehicle is clean and dry before the cover is fitted, and for fitting, removing and storing the cover with reasonable care. Dirt, dust, sand, grit, moisture, road salt or other contaminants trapped between the cover and the vehicle surface can cause marks or micro-scratches regardless of the quality of the cover.
30.3 Pre-existing and unrelated damage. We are not liable for damage, wear, discolouration, paint or film defects, corrosion or deterioration of the vehicle that existed before the cover was used, that results from the condition or previous treatment of the vehicle (including poor-quality paint or repainting, damaged clear coat, or unsuitable wraps or films), or that is caused by factors unrelated to the cover, such as weather, environmental influences, or third parties.
30.4 Improper use. We are not liable for damage caused by use of the cover in a way that is not reasonable or not in line with its intended purpose, for example fitting it on a dirty or wet vehicle, fitting it on a hot surface, or insufficiently securing it.
30.5 Our liability remains. Nothing in this Section limits our liability for a defective or non-conforming product (including where a defect in the cover itself, such as faulty material, seams, fasteners or a manufacturing flaw, causes damage to the vehicle), for fraud, intentional misconduct or gross negligence, for death or personal injury, or for any other liability that cannot lawfully be excluded or limited. Where damage to the vehicle is shown to have been caused by a defect in the cover, the customer’s statutory rights apply.
